Your Previsit, Inc. (“Your Previsit,” “we,” or “us”) is the owner and operator of YourPrevisit.com (the “Website”) and our mobile application (the “App”), which together and with the contents and offerings of each, constitute our services (the “Services”). In providing the Services, we take our users’ privacy and security very seriously. This Privacy Notice & Cookie Policy (the “Privacy Policy”) explains how we collect, use, share and protect information about the users of our Services (“users” or “you”). Your Previsit collects information about you when you use or access our Services or any part of them and through other interactions and communications you have with us. By accessing or using our Services, you consent to the collection, transfer, manipulation, storage, disclosure and other uses of Your Information (as defined immediately below) in the ways described in this Privacy Policy. For purposes of this Privacy Policy, “Your Information” means information about you that might be of a confidential or sensitive nature and might include personally identifiable information (“PII”) or financial information or other sensitive data or information. PII means individually identifiable information that would allow the determination of the identity of a specific living person such as name, email address, account numbers, etc.), while sensitive data may include information, comments, content and other information that you voluntarily provide. You acknowledge and accept that Your Previsit is not a covered entity as such term is defined by the Health Insurance Portability and Accountability Act (“HIPAA”) and is therefore not subject to HIPAA’s information sharing, protection, or storage requirements. Notwithstanding the foregoing, Your Previsit does not collect or store any protected health information as defined in HIPAA except to the extent that demographic, identifying, and contact information overlaps with such protected health information, and Your Previsit stores and protects your information as set forth in this Privacy Policy.  This Privacy Policy applies to persons and businesses anywhere in the world that use our Services. By accessing and using the Services we offer, you are agreeing to be bound by this Privacy Policy in respect of the information collected.  This Policy does not govern information we receive from third parties.  If you do not agree to the terms of this Policy, please do not use the Website, or use or access any of the Services.  Each time you use a use or access any Services, the current version of this Privacy Policy will apply. Accordingly, when you use any Services, you should check the date of this Privacy Policy (which appears at the top of this page) and review any changes since you last reviewed the Privacy Policy.

1.          Types of Information We Collect

We may collect two types of information from users of our Services, Personal Information, and information that is not specific to you and cannot be used to identify you (such as frequency of visits to the Websites, browser types used to access our Services, etc.) (“Anonymous Information”).

1.1.       Personal Information Collected

1.1.1.    We collect Personal Information that you provide, or someone acting on your behalf provides, voluntarily to us when you use our Services.  For example, you may provide us with your email address, first name and last name, telephone number, mailing address, payment information, or other Personal Information when you request information, create or modify your registration/account, access or use our Services, complete a form or application, contact customer support, or otherwise communicate with us.  Other information may be collected automatically, through the use of various technologies, including, but not limited to cookies and pixel tags, including, without limitation, your IP address, browsing behavior, and your device identification.  These types of information shall be treated as Personal Information to the extent they can be used to identify you.  We also collect certain “sensitive personal information” as defined and used by the California Privacy Rights Act and the California Consumer Privacy Act (the “Acts”), including the log-in credentials you use to access our Website and our Services.  We do not use or disclose sensitive personal information for any purposes not expressly permitted by the Acts and other applicable laws.

1.1.2.    We collect Personal Information when it is needed to allow or facilitate your use of our Services. These types of information shall be treated as Personal Information to the extent they can be used to identify you.

1.1.3.    Our Services are designed to allow you to share information publicly or with third parties. If you choose to make public, or share with third parties, information through our Services, please understand that we cannot control the actions of third parties who could collect this information. 

1.1.4     We do not capture or store payment information, including credit/debit card details or billing information. We do, however, facilitate the transfer of your payment information to third party payment processors and in-app payment solutions when you enter your payment details for our Services. All payments are handled by third party secure payment providers.

1.2.       Collection of Personal Information by Third Parties

Some links or referrals provided in or through our Services may redirect you to third party websites or services that we do not operate.  The privacy and security practices of these websites and services will be governed by their own policies.    We make no representation or warranty as to the privacy policies of any third parties, including the providers of third-party applications.  If you are submitting information to any third party, through our Services or otherwise, you should review and understand that party’s applicable policies, including its privacy policy, before providing your information to the third party. 

1.3.       Anonymous Information Collected

1.3.1.    Anonymous Information does not identify any user.  Anonymous Information may be collected when you access, use, or otherwise interact with our Services, independent of any information you voluntarily enter or provide.  Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only Anonymous Information remains.  We may collect, use, store, and transfer Anonymous Information without restriction. 

1.3.2.    When you access our Services, some Anonymous Information is automatically collected through the use of various technologies, including, but not limited to cookies and pixel tags.  Such information could include your operating system the site from which you linked to us, the name of the website you choose to visit immediately after our Website, information about other websites you have recently visited, type of software used to browse the internet, and language, device identifier numbers, your site activity, and the time and date of your visit.  We use this information to better understand how our Services are being used by visitors, and it allows us to administer and customize the Services to improve your overall experience and that of our other users. We may combine this automatically collected log information with other information we collect about you.  Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to “Do Not Track” signals from your browser at this time.

1.3.3.    We maintain all Anonymous Information on a de-identified basis, do not attempt to re-identify it, and have no ability to re-identify it.

1.4.       How We Collect Personal Information; Use of “Cookies” 

1.4.1.    Information You Give Us. We collect your‎ email address, name, postal address, phone number, demographic information (such as your gender and occupation) as well as other information you directly give us through our Services.

1.4.2.    Information We Get From Others. We may receive information about you from other sources that are not affiliated with the Company and add that to the information you have provided to us. This information might be public information or data you provided to others with authorizations to share it with third parties.

1.4.3.    Information Automatically Collected. We automatically log information about you and your computer. For example, when visiting our Services, we log your computer operating system type, browser type, browser language, IP address, and navigation history, pages you viewed, how long you spent on a page, access times and information about your use of and actions on our Services.

1.4.4.    Some of our sites may use cookies, including persistent cookies, which stay on your computer until you delete them. Cookies are alphanumeric identifiers that are transferred to your computer’s hard drive through your web browser to help the Website identify you when you visit.  You have choices with respect to cookies.  By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies.  If you choose to reject all cookies, you may be unable to use those aspects of our Website and Services that require registration in order to participate.  You can learn more about cookies and how they work at www.allaboutcookies.org.  You can always disable cookies through your browser settings or through the cookie preferences page   or window on our Website. Your Previsit cannot control the use of cookies by third parties (or the resulting information), and use of third party cookies is not covered by this policy.

1.4.5.    We may also receive information from other sources and combine that with information we collect through our Services. For example if you choose to link, create, or log in to your Your Previsit account with a social media service, e.g. Facebook, or a payment provider, e.g. Apple Pay or Google Wallet, or if you engage with a separate App or Website that uses our API, or whose API we use, we may receive information about you or your connections from that Site or App. We may collect information about you from sources other than you, such as from social media websites (i.e., Facebook, LinkedIn, Twitter or others), blogs, other users and our business partners.  When you use the Services we may collect your precise location data. We may also derive your approximate location from your IP address.  In connection with providing Service, we may receive call data, including the date and time of the call or SMS message, the parties phone numbers, and the content of the SMS message. You consent to the receipt, collection and storage of this information.

1.5.       Analytics

We may use third parties, such as Google Analytics or other analytics providers, to analyze traffic to a website. Google Analytics does not create individual profiles for visitors and only collects Anonymous Information. 1.6.       Tracking

We may also use cookies, pixels, beacons, or other web tracking technologies to track the amount of time spent on our Website, App, or social media and whether or not certain content was viewed. We may work with a third party to collect and process this information for us, based on our instructions and in full compliance with this Policy.

  1. Interest-Based Advertising:  

1.7.1.    We may also participate in interest-based advertising using similar technology. This means that you may see advertising on our Websites or other Services tailored to how you browse or shop, or you may see advertising for Your Previsit and its Services on other websites based on your browsing behavior across websites. Some websites where we may advertise belong to ad networks that use your web browsing history to choose which ads to display on their network websites; these ads include advertising for Your Previsit and its Website or Services.  Other websites where you see our ads, such as Facebook, may use interest preferences that you have chosen on those sites, as well as registration and other information about you, to choose which ads to display to you. Some internet browsers, websites such as Facebook, and mobile devices offer opt-outs for interest-based advertising. Please refer, as appropriate, to the website that you are visiting, your browser’s settings, or your device’s settings for additional information and to modify your preferences.

1.7.2.    You can opt-out of receiving interest-based ads from third parties who are members of the Network Advertising Initiative (“NAI”) or who follow the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out pages on the NAI website (http://www.networkadvertising.org/choices/) and on the DAA’s website (http://www.aboutads.info/choices/).

1.8        Use of Personal Information:

1.8.1.     For Your Benefit. We use your Personal Information to provide you with Services and information that you have requested from us or that we think may be of interest to you; to respond to comments and questions and provide customer service; and to communicate with you about promotions and other news about products and services offered by us and our selected partners. Additionally, we will include your Personal Information when creating a profile for you. We keep your profile up to date by adding information about your registrations or subscriptions, the content you access, how you interact with our offerings, and the like.

1.8.2.    To Improve Our Business. We will use your Personal Information in order to ask for your input to help in our research about our Services. We may also send your Personal Information in confirmations, technical notices, updates, security alerts, and support and administrative messages. We may link or combine your Personal Information with the Personal Information of others in connection with our business.

1.8.3     We may also use the information we collect about you to: Send you communications we think will be of interest to you, including information about products, services, promotions, news, and events of Your Previsit and other companies, where permissible and according to applicable law. We may use your information to display advertising, including advertising that is targeted to you based on your location, interests, as well as your Your Previsit activities. We may use your information to verify your identity and prevent impersonation, spam or other unauthorized or illegal activity.

2.         Sharing of Personal Information with Third Parties

2.1.       Some collection, use, or sharing of your Personal Information  may be considered “processing” for purposes of the General Data Protection Regulation 2016/679 (“GDPR”). We process (as that term is defined in the GDPR) and may share your Personal Information as follows.

2.2.       We may rely on third parties for the delivery of Services, and, in doing so, we may need to transfer Personal Information to them for the purpose of providing the Services.  We may disclose Personal Information to our affiliates, subsidiaries, or third-party service providers to provide you with the Services.  For example, we may transfer your Personal Information to third party service providers to assist with providing the Services or communicate with you about current or future offerings. These third-party service providers are not authorized to retain, share, store or use the Personal Information for any purposes other than to provide the services they have been hired to provide.  In no event will we sell any Personal Information to any third-party.

2.3.       We may also transfer your Personal Information to third parties under special circumstances to (i) to comply with a legal requirement, judicial proceeding, court order, or legal process served on us; (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of Your Previsit; (iv) when we believe it is necessary to protect the rights, property, or safety of Your Previsit  or other persons, or (v) as otherwise required or permitted by law, including in connection with contractual obligations or business operations of Your Previsit.  Your Previsit is committed to cooperating with law enforcement while respecting each individual’s right to privacy. If Your Previsit receives a request for user account information from a government agency investigating criminal activity, we will review the request to be certain that it satisfies all legal requirements before releasing information to the requesting agency.  Further, under federal law, specifically 18 U.S.C. §§ 2702(b)(8) and 2702(c)(4) (Voluntary Disclosure Of Customer Communications or Records), Your Previsit may disclose user account information to law enforcement, without a subpoena, court order, or search warrant, in response to a valid emergency when we believe that doing so is necessary to prevent death or serious physical harm to someone. Your Previsit will not release more information than it prudently believes is necessary to prevent harm in an emergency situation.

            2.4        Our Services may now or in the future integrate with social sharing features and other related tools that let you share actions you take on our Services with other apps, sites, or media, and vice versa. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the social sharing service. Please refer to the privacy policies of those social sharing services for more information about how they handle the data you provide to or share through them. Any information or content that you voluntarily disclose for posting to the Service becomes available to the public, as controlled by any applicable privacy settings that you set. Once you have shared User Content or made it public, that User Content may be re-shared by others. If you remove information that you posted to the Service, copies may still remain viewable in cached and archived pages of the Service, or if other users or third parties, using the Service, have re-shared, copied or saved that User Content.

2.5.       If you are a resident of the European Union or European Economic Zone or using our Services from either, you should be aware that your Personal Information will likely be transferred to the United States. Your Previsit is a United States-based operation with a home office in California, USA, and it only transfers personal or private information across international borders in accordance with its binding corporate policies or with your consent. The data controller for activities described herein is Your Previsit, Inc. By using and accessing our products and services, users who reside or are located in countries outside of the United States agree and consent to the transfer to and processing of personal information on servers located outside of the country where they reside, and that the protection of such information may be different than required under the laws of their residence or location.

3.         Retention of Personal Information

Your Previsit will retain your Personal Information for as long as you use the Services, and thereafter for as long as reasonably necessary for Your Previsit’s offering of the Services, as may be permitted or is required by applicable law or ongoing business needs, or otherwise as we communicate to you, and for as long as necessary to comply with our legal obligations, resolve disputes or prevent abuse.  Notwithstanding the foregoing, upon your request, Your Previsit will correct or remove any or all of your Personal Information in keeping with section 4, below.  We will retain such Personal Information for no longer than a reasonable period of time after we believe you will no longer receive Services. When we no longer have an ongoing business need to access your Personal Information we will securely delete or anonymize it.

4.         Corrections/Information Removal/Opt-Out/Non-Discrimination/Rights

4.1.       You have the following rights with respect to your Personal Information: (i) Right to Be Informed. You have the right be informed about our use of your Personal Information. You may request the categories of Personal Information we have collected, the source of such Personal Information, our use of such Personal Information, and if such Personal Information was sold or otherwise provided to third parties, the categories of Personal Information disclosed or sold to third parties and the categories of third parties to whom such Personal Information was disclosed or sold. (ii) Right to Withdraw Consent. You may withdraw your consent to our use of your Personal Information or opt out of our sharing your Personal Information with others. (iii) Right to Access. You may request a copy of the Personal Information we collected about you (unless legally required, we will limit this to the Personal Information collected during the 12 months prior to your request). (iv) Right to Correct. You may also correct and update the Personal Information we have on record. (v) Right to Limit. You may request that we restrict our processing (as that term is defined in the GDPR) of your data or modify your choices about how and when we contact you. (vi) Right to Portability. You may ask us to port your data in a machine readable format to a third party. (vii) Right to Deletion. You may request that remove or delete your Personal Information. We may decline to delete your Personal Information if legally permitted, and retention is required to provide you with Services, detect or resolve security issues, comply with the law, or carry out actions for our internal purposes that you and other consumers would ordinarily anticipate.

4.2.       You can exercise the rights listed above, including requesting at any time that any Personal Information stored by us to be deleted or corrected, or that our use of such information be limited, by contacting us at support@yourprevisit.com  We will make our best efforts to respond to your request within 45 days of receiving it.  We may require you to provide certain information to verify that it is you who is making the request.  We will not, however, delete or limit our use of information that we are required to retain and use in order to comply with applicable laws and regulations or, unless you expressly agree to terminate our Services, provide existing Services to you that you have, or someone acting on your behalf has, requested or subscribed to, including by continuing to use such Services.

4.3        You may correct your account information or your personal information at any time by logging into your online account. If you wish to cancel your account or make changes to information not available by logging into your account, please write to us at support@yourprevisit.com.  In some cases we may retain certain information about you as required by law, or for legitimate business purposes to the extent permitted by law. For instance, if you have a standing credit or debit on your account, or if we believe you have committed fraud or violated our Terms & Conditions of Use, we may seek to resolve the issue before deleting your information. Your Previsit will comply with individual’s requests regarding access, correction, and/or deletion of the personal data it stores in accordance with applicable law.

4.3.       If you no longer wish to receive any newsletters and promotional communications, you may opt-out of receiving them by following the instructions included in each communication.

4.4.       We will not discriminate or retaliate against you or against any consumer for exercising the rights provided by or protected by the Act the GDPR or any other applicable law.

5.         Children and Privacy

We do not knowingly collect Personal Information from children in connection with our Services. Our Services are intended for users who are 18 years old or older. We do not knowingly collect Personal Information from persons under the age of 13. If you are under the age of 13, you may not provide us with information of any kind whatsoever. If we become aware that we have inadvertently received Personal Information from a person under the age of 13 we will delete such information from our records.  If we become aware that an individual under the age of 13 has provided personally identifiable information to us, we will immediately remove the individual’s personally identifiable information from our files.    

6.         How Do We Protect Your Information?

6.1.       We take the security of your Personal Information very seriously.  We use the administrative, physical, procedural, and technical safeguards reasonably available to secure the Personal Information you share with us. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls. Although we take measures to secure your information, we do not promise, and you should not expect, that your personal information, or searches, or other information will always remain secure. We cannot guarantee the security of our information storage, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet, including, without limitation, email and text transmissions.  Further, despite the safeguards we enact to secure your information, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information.

6.2.       Any email or other communication purporting to be from one of our websites asking you to provide sensitive information via email, should be treated as unauthorized and suspicious and should be reported to us immediately by emailing support@yourprevisit.com.  We recommend that you not respond to any such communication, provide any of the information requested, follow any link or visit any website provided in such message, or open any attachment included with such communication.

7.         Will We Change This Policy?

Each time you use our Services the current version of the Privacy Policy will apply. When you use our Services, you should check the date of this Privacy Policy (which appears at the top of the Policy) and review any changes since the last version. Our business changes frequently and this Policy is subject to change from time to time. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you. We will not materially change our policies or practices to make them less protective of your privacy without the consent or agreement of affected users.
